Privacy Policy

This Privacy Policy describes how Nail Your Ledger LLC ("Nail Your Ledger," "we," "us," or "our"), a Nevada limited liability company, collects, uses, discloses, and protects information when you visit nailyourledger.com, schedule a meeting, contact us, or otherwise interact with our website.

1. Information we collect

Information you provide. Depending on how you interact with us, we may collect:

  • Your name and business name.
  • Your individual or business email address.
  • Your business's approximate annual revenue.
  • The bookkeeping software, accounting platform, spreadsheet, or other system your business uses.
  • Your phone number, if you choose to provide it.
  • A description of the biggest financial or bookkeeping issue facing your business, if you choose to provide it.
  • Meeting preferences, communications, and other information you submit through Calendly, email, or another contact method.

Please do not submit Social Security numbers, tax identification numbers, bank credentials, payment-card details, accounting-platform passwords, or other highly sensitive credentials through this website or Calendly.

Information collected automatically. We and our service providers may automatically collect information such as your IP address, browser and device type, operating system, referring pages, pages viewed, approximate location derived from IP address, interactions with the site, and cookie or analytics identifiers.

Information from third parties. We may receive information from Calendly when you schedule a meeting, from analytics and hosting providers, from referrals, or from other sources you authorize.

2. How we use information

We may use information to:

  • Respond to inquiries and schedule introductory meetings.
  • Evaluate whether our bookkeeping and financial-management services may fit your business.
  • Prepare proposals, follow up with potential clients, and maintain lead and customer records.
  • Provide services if you later enter into a written client agreement with us.
  • Store and organize information on systems controlled by or provided for Nail Your Ledger, including a private server.
  • Operate, secure, troubleshoot, and improve the website and our business processes.
  • Understand website usage and marketing effectiveness.
  • Comply with law, enforce agreements, and protect our rights, users, and business.

3. We do not sell personal information

Nail Your Ledger does not sell your personal information. We do not knowingly sell or share personal information for cross-context behavioral advertising as those terms are defined by the California Consumer Privacy Act.

4. When we disclose information

We may disclose information to:

  • Service providers that help us host, secure, analyze, communicate, schedule, or operate the website and business, including Cloudflare, Google Analytics, Calendly, email providers, and infrastructure or private-server providers.
  • Professional advisers, such as attorneys, accountants, insurers, or consultants, when reasonably necessary.
  • Government authorities or other parties when required by law, legal process, or reasonably necessary to protect rights, safety, or prevent fraud.
  • A successor organization in connection with a merger, financing, acquisition, reorganization, or sale of all or part of the business.
  • Other parties with your direction or consent.

Service providers may process information under their own terms and privacy notices. For example, meeting scheduling is provided by Calendly and website analytics are provided by Google.

5. Cookies and analytics

We use Google Analytics and related technologies to understand site traffic and usage. These tools may use cookies or similar technologies and may collect device, network, and interaction data. You can limit cookies through your browser settings and may use Google's available analytics opt-out tools. Calendly resources load when you select a scheduling link and Calendly may then collect information under its own privacy policy.

6. Retention

We retain information for as long as reasonably necessary for the purposes described in this policy, including responding to inquiries, maintaining business records, providing services, resolving disputes, enforcing agreements, and satisfying legal, tax, accounting, or security obligations. When information is no longer reasonably needed, we may delete or de-identify it.

7. Security

We use reasonable administrative, technical, and organizational measures intended to protect information. However, no website, server, transmission method, or storage system can be guaranteed to be completely secure. You provide information at your own risk and should avoid sending highly sensitive credentials through public website channels.

8. Your choices and California privacy rights

You may ask us to provide access to, correct, or delete personal information that you have submitted, subject to verification and legal retention requirements. You may also ask us to stop nonessential marketing communications.

If Nail Your Ledger becomes subject to the California Consumer Privacy Act (CCPA), eligible California residents may have rights to know, access, delete, and correct personal information; to opt out of sale or sharing; to limit certain uses of sensitive personal information; and to receive equal service when exercising those rights. We do not sell personal information or knowingly share it for cross-context behavioral advertising.

To submit a privacy request, email legal@nailyourledger.com with the subject line "Privacy Request." We may request information reasonably necessary to verify your identity and authority. An authorized agent may submit a request where permitted by applicable law.

9. Do Not Track and Global Privacy Control

Some browsers offer a "Do Not Track" setting. Because there is no uniform industry standard for responding to that signal, the site does not currently respond to Do Not Track signals. We do not sell personal information or knowingly share it for cross-context behavioral advertising. If our practices change or applicable law requires a response to a recognized opt-out preference signal, such as Global Privacy Control, we will process that signal as required.

10. Children

This site and our services are intended for business representatives who are at least 18 years old. We do not knowingly collect personal information from children under 13. If you believe a child has submitted information to us, contact us so we can review and delete it where appropriate.

11. United States-directed services

This site and our services are directed primarily to businesses and authorized business representatives located in the United States. If you are outside the United States, do not submit personal information or use the site to request services unless Nail Your Ledger has expressly agreed to work with you. Information may be processed and stored in the United States, where privacy laws may differ from those in your location.

This statement does not waive any rights that cannot legally be waived and does not prevent a law from applying when it otherwise applies. Accepting a client outside the United States may require separate contract and privacy terms.

12. Third-party sites and services

The site may link to Calendly, LinkedIn, and other third-party services. We do not control and are not responsible for their content, availability, security, or privacy practices. Review their policies before submitting information.

13. Changes to this policy

We may update this Privacy Policy from time to time. The revised version will be posted on this page with an updated effective date. Material changes may also be communicated through other reasonable means.

Website Terms

Terms of Service

These Terms of Service ("Terms") govern your access to and use of nailyourledger.com and its content. By using the site, you agree to these Terms. If you do not agree, do not use the site.

1. Eligibility and United States focus

You must be at least 18 years old and legally capable of entering into these Terms. If you use the site on behalf of a business, you represent that you have authority to act for that business. The site is directed primarily to United States-based businesses and their authorized representatives. Persons outside the United States are not authorized to use the site to request services unless Nail Your Ledger expressly agrees otherwise.

2. Website information is not a client engagement

The website provides general information about Nail Your Ledger and its potential services. Visiting the site, submitting information, sending an email, or scheduling an introductory call does not create a client, fiduciary, accountant-client, or other professional relationship. A client relationship begins only after Nail Your Ledger and the client sign a separate written engagement agreement.

3. Nature of services and professional limitations

Nail Your Ledger provides non-CPA bookkeeping, job-costing, cash-flow forecasting, management reporting, financial operations support, and related advisory or fractional finance services for construction contractors. Unless a signed engagement agreement expressly states otherwise:

  • We are not a certified public accounting firm and do not provide CPA services.
  • We do not perform audits, reviews, compilations, attest services, or provide assurance on financial statements.
  • Website content and introductory discussions are not tax, legal, investment, lending, insurance, or other regulated professional advice.
  • You remain responsible for business decisions, internal controls, source-document accuracy, legal compliance, tax filings, and consulting qualified licensed professionals when appropriate.

Any paid services, fees, deliverables, responsibilities, guarantees, refund terms, confidentiality obligations, and service limitations will be governed by the applicable signed engagement agreement. If that agreement conflicts with these website Terms, the signed engagement agreement controls for the client services it covers.

4. Information you submit

You agree that information you provide through the site is accurate, current, and submitted lawfully. You must not submit information that you do not have authority to disclose. Do not send passwords, bank-login credentials, Social Security numbers, payment-card details, or similarly sensitive credentials through the website or Calendly.

You grant us permission to use information you submit to respond to you, evaluate a potential engagement, operate our business, and perform the activities described in the Privacy Policy.

5. Scheduling and communications

Scheduling a meeting does not guarantee availability, acceptance as a client, a particular result, or eligibility for any offer. By providing contact information, you authorize us to respond about your inquiry and potential services. Providing a phone number is optional and does not by itself authorize automated marketing calls or texts where separate consent is legally required.

6. Acceptable use

You may not:

  • Use the site for unlawful, fraudulent, abusive, or misleading activity.
  • Attempt to gain unauthorized access to the site, servers, accounts, or data.
  • Introduce malware, interfere with site operation, scrape the site excessively, or bypass security controls.
  • Copy, republish, or commercially exploit site content except as permitted by law or with our written permission.
  • Misrepresent your identity, authority, business, or relationship with another person or entity.

7. Intellectual property

The site, branding, logos, text, graphics, layout, and other content are owned by or licensed to Nail Your Ledger and are protected by applicable intellectual-property laws. We grant you a limited, revocable, nonexclusive right to access and use the site for evaluating our services. No other rights are granted.

8. Third-party services and links

The site may use or link to third-party services such as Calendly, Google Analytics, Cloudflare, LinkedIn, and other websites. Nail Your Ledger does not control those services and is not responsible for their terms, content, security, availability, or privacy practices. Your use of third-party services is governed by their own agreements.

9. No warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." NAIL YOUR LEDGER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AVAILABILITY, AND SECURITY.

We do not warrant that the site will be uninterrupted or error-free, that content will always be current, or that using the site will produce any particular financial, operational, or business result.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NAIL YOUR LEDGER AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR LOSSES ARISING FROM RELIANCE ON WEBSITE CONTENT OR USE OF THIRD-PARTY SERVICES.

To the fullest extent permitted by law, total liability arising from or relating to the website will not exceed one hundred U.S. dollars ($100). These limitations do not apply where prohibited by law and do not alter liability terms in a separate signed client agreement.

11. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Nail Your Ledger and its owners, officers, employees, contractors, and agents from claims, damages, liabilities, and expenses arising from your unlawful misuse of the site, your violation of these Terms, or information you submit without proper authority.

12. Governing law and venue

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles. Any dispute arising solely from use of the website will be brought in a state or federal court of competent jurisdiction located in Nevada, unless applicable law requires otherwise. Client-service disputes may be governed by the dispute provisions in the applicable engagement agreement.

13. Changes, suspension, and termination

We may update these Terms by posting a revised version with a new effective date. We may modify, suspend, or discontinue any part of the site at any time. Your continued use after an update means you accept the revised Terms.

14. Severability and entire agreement

If a provision of these Terms is found unenforceable, the remaining provisions remain effective and the affected provision will be enforced to the maximum extent permitted. Our failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the entire agreement concerning your use of this website, but they do not replace a signed client engagement agreement.
